§ 1 Geltungsbereich
Diese AGB regeln die Nutzung der App autoscrolly als mobile Anwendung. Durch Installation oder Nutzung erklären Sie sich einverstanden. Anbieter ist die im Impressum genannte Person. Diese AGB gelten für private, nicht-kommerzielle Nutzung.
§ 2 Gegenstand und Leistungsbeschreibung
autoscrolly ist eine Anwendung zum Anzeigen und automatischen Scrollen von PDF-Dokumenten. Die App bietet PDF-Anzeige, automatisches Scrollen mit einstellbarer Geschwindigkeit, anpassbare Anzeigeoptionen und eine lokale Dateibibliothek. Es findet keine Bearbeitung, Konvertierung oder Übertragung von PDF-Dateien statt.
§ 3 Nutzungsberechtigung und Nutzerpflichten
Die App ist für alle Altersgruppen geeignet. Der Nutzer ist allein verantwortlich dafür, dass verwendete PDF-Dateien rechtmäßig erworben und zur Nutzung berechtigt sind, keine urheberrechtlich geschützten Inhalte ohne Lizenz genutzt werden und die App nicht für gewerbliche Zwecke ohne Genehmigung eingesetzt wird.
§ 4 Urheberrecht der verwendeten Dokumente
autoscrolly ist ein Werkzeug zur Anzeige von Dokumenten, die der Nutzer selbst bereitstellt. Die Verantwortung für die rechtmäßige Nutzung liegt ausschließlich beim Nutzer. Der Anbieter weist darauf hin, dass die Nutzung urheberrechtlich geschützter Notenblätter oder Tabs ohne entsprechende Lizenz gegen geltendes Urheberrecht verstoßen kann.
§ 5 Datenverlust und Dateimanagement
Der Anbieter weist ausdrücklich darauf hin, dass PDF-Dateien und Einstellungen bei Deinstallation, Gerätewechsel ohne Backup oder technischen Defekten verloren gehen können. Der Anbieter haftet nicht für den Verlust lokal gespeicherter Dateien.
§ 6 Haftungsausschluss
Der Anbieter haftet unbeschränkt für Schäden aus Vorsatz oder grober Fahrlässigkeit sowie für Personenschäden. Im Übrigen ist die Haftung — soweit gesetzlich zulässig — ausgeschlossen, insbesondere für Verlust gespeicherter Dateien, Darstellungsfehler bei bestimmten PDF-Formaten, urheberrechtliche Verletzungen durch den Nutzer und Inkompatibilitäten.
§ 7 Verfügbarkeit und Updates
Der Anbieter strebt hohe Qualität an, übernimmt jedoch keine Garantie für fehlerfreie Darstellung aller PDF-Formate auf allen Geräten. Auf Updates besteht kein Anspruch.
§ 8 Geistiges Eigentum an der App
Alle Rechte an der App stehen dem Anbieter zu. Kopieren, Dekompilieren oder Reverse Engineering ist ohne schriftliche Genehmigung untersagt. Die verwendeten PDF-Dokumente verbleiben im Eigentum des Nutzers bzw. der Rechteinhaber.
§ 9 Abonnements und In-App-Käufe
autoscrolly bietet zwei optionale Abonnement-Modelle an: ein monatliches und ein jährliches Abonnement. Beide Abonnements gewähren Zugang zu erweiterten Funktionen der App. Die Basisversion der App bleibt ohne Abonnement kostenlos nutzbar. Es gelten folgende Bedingungen:
- Preisanzeige: Der jeweils aktuelle Preis wird vor dem Kauf im Apple App Store angezeigt.
- Abwicklung: Abonnements werden über den Apple App Store abgewickelt und unterliegen dessen Nutzungsbedingungen (apple.com/legal/internet-services/itunes).
- Automatische Verlängerung: Die Abrechnung erfolgt automatisch zum jeweiligen Verlängerungsdatum, sofern das Abonnement nicht mindestens 24 Stunden vor Ablauf des aktuellen Zeitraums gekündigt wird.
- Kündigung: Die Kündigung erfolgt ausschließlich über die Einstellungen des Apple App Store-Kontos (Einstellungen → Apple-ID → Abonnements).
- Kostenloser Testzeitraum: Sofern ein kostenloser Testzeitraum angeboten wird, geht dieser automatisch in ein kostenpflichtiges Abonnement über, sofern er nicht rechtzeitig (mindestens 24 Stunden vor Ende) gekündigt wird.
- Keine Rückerstattung: Bereits bezahlte Zeiträume werden nicht erstattet. Ausnahmen gelten nur, soweit gesetzlich vorgeschrieben.
- Preisänderungen: Preise können sich ändern; Nutzer werden rechtzeitig und transparent informiert.
- Widerrufsrecht: Bei digitalen Inhalten, die sofort nach Kaufabschluss bereitgestellt werden, erlischt das gesetzliche Widerrufsrecht mit Beginn der Ausführung, sofern der Nutzer ausdrücklich zugestimmt hat (§ 356 Abs. 5 BGB). Die Zustimmung erfolgt im Rahmen des Kaufprozesses im App Store.
- Minderjährige: Minderjährige benötigen die Zustimmung eines Erziehungsberechtigten.
§ 10 Änderungen der AGB
Sofern der Nutzer nicht innerhalb von vier Wochen widerspricht und die App weiterhin nutzt, gelten Änderungen als akzeptiert.
§ 11 Anwendbares Recht
Es gilt deutsches Recht. Für Verbraucher bleiben zwingende Schutzbestimmungen des Aufenthaltsstaats unberührt. Zur Teilnahme an Schlichtungsverfahren ist der Anbieter nicht verpflichtet.
§ 12 Salvatorische Klausel
Sollte eine Bestimmung unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§ 1 Scope of Application
These Terms govern the use of autoscrolly as a mobile application. By installing or using the App, you agree to these Terms. The App is provided by the individual identified in the legal notice for private, non-commercial use.
§ 2 Description of the App
autoscrolly is a PDF viewer with auto-scroll functionality. It offers PDF display, automatic scrolling at adjustable speeds, customizable display options, and a local file library. No editing, conversion, or transmission of files takes place.
§ 3 Eligibility and User Obligations
Suitable for all ages. The user is solely responsible for ensuring PDFs are legally acquired and licensed, that no copyrighted content is used without a valid license, and that the App is not used for commercial purposes without permission.
§ 4 Copyright of Used Documents
autoscrolly is a display tool for user-provided documents. The Provider has no visibility into files used. The user bears sole responsibility for lawful use of all documents. The Provider notes that using copyrighted sheet music or tabs without a valid license may infringe applicable copyright law.
§ 5 Data Loss and File Management
The Provider expressly notes that PDF files and settings may be permanently lost if the App is uninstalled, the device is changed without a backup, or a technical failure occurs. The Provider accepts no liability for such loss.
§ 6 Limitation of Liability
The Provider is fully liable for intentional misconduct, gross negligence, and personal injury. Otherwise, liability is excluded to the maximum extent permitted by law, including for loss of saved PDFs, rendering errors, copyright infringement by the user, and device incompatibilities.
§ 7 Availability and Updates
The Provider aims for high quality but does not guarantee error-free display of all PDF formats. No right to updates or continued development exists.
§ 8 Intellectual Property
All rights to the App belong to the Provider. Copying, decompiling, or reverse-engineering without prior written permission is prohibited. PDF documents used remain the property of the user or respective rights holders.
§ 9 Subscriptions and In-App Purchases
autoscrolly offers two optional subscription plans: a monthly and an annual subscription. Both plans unlock access to extended features of the App. The basic version of the App remains free to use without a subscription. The following conditions apply:
- Pricing: The current price is displayed in the Apple App Store before purchase.
- Processing: Subscriptions are processed through the Apple App Store and are subject to its terms and conditions (apple.com/legal/internet-services/itunes).
- Automatic renewal: Billing recurs automatically at the end of each subscription period unless cancelled at least 24 hours before the renewal date.
- Cancellation: Cancellation must be made through the Apple App Store account settings (Settings → Apple ID → Subscriptions).
- Free trial: If a free trial is offered, it will automatically convert to a paid subscription unless cancelled at least 24 hours before the trial ends.
- No refunds: Payments already made are non-refundable, except where required by law.
- Price changes: Prices may change; users will be notified in advance and transparently.
- Right of withdrawal: For digital content made available immediately upon purchase, the statutory right of withdrawal expires upon commencement of performance, provided the user has given explicit consent. Consent is given during the App Store purchase process.
- Minors: Minors require parental consent before subscribing.
§ 10 Changes to the Terms
If the user does not object within four weeks of notification and continues using the App, amended Terms are deemed accepted.
§ 11 Governing Law
German law applies. Mandatory consumer protection provisions of the user's country of residence prevail. The Provider is neither obligated nor willing to participate in consumer arbitration.
§ 12 Severability
Should any provision be invalid, the remaining provisions shall remain unaffected.
